1. Introduction
Welcome to Palms and Pixels. By engaging our web design, development, and hosting services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before starting a project with us.
2. Scope of Work & Development
We build custom, hand-coded websites tailored to small businesses. Project scopes, deliverables, and features are agreed upon prior to project commencement. Any major feature additions outside the initial agreed scope may require a separate quote or adjustment to the project timeline.
3. Subscription Hosting & Maintenance
Our ongoing monthly plans cover managed hosting, SSL certificates, continuous performance optimization, and routine maintenance.
- Billing: Monthly fees are billed automatically in advance. Service may be suspended if payments fail or lapse past the grace period.
- Cancellation: You may cancel your monthly subscription at any time. Upon cancellation, you retain ownership of your text content and media, though custom code architectures built specifically for our managed infrastructure remain proprietary if transferring away.
4. Understanding "Unlimited Updates"
Where included in your plan, "unlimited updates" covers standard, routine content changes to keep your site fresh and accurate. To ensure fair use for all clients, this policy operates under specific professional guidelines:
- What is included: Text revisions, swapping out images, updating pricing, adding blog posts, modifying operating hours, or minor layout adjustments.
- What is excluded: Full website redesigns, building entirely new multi-page sections or complex web applications from scratch, or structural overhauls that constitute a brand-new project scope.
- Turnaround: Routine update requests are generally processed and completed within 24 to 48 business hours.
5. Client Responsibilities
To keep projects moving efficiently, clients agree to provide necessary materials (such as business logos, copy, images, and brand preferences) in a timely manner. Delays in providing content may result in adjusted project delivery schedules.
6. Limitation of Liability
Palms and Pixels will not be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use our services, including loss of business revenue or search engine ranking fluctuations outside of our direct control.
7. Governing Law
These terms are governed by and construed in accordance with the laws of the United Kingdom, and any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts of the UK.
